2. Acceptance of Terms
By submitting a timepiece for service, making an enquiry through our website, or engaging our team by telephone or in person, you confirm that:
- You have read and understood these Terms and Conditions in their entirety;
- You are at least 18 years of age, or are acting with the consent and authority of a guardian;
- You have the legal capacity and authority to enter into this Agreement and, where applicable, to authorise work on the timepiece submitted;
- Where the timepiece belongs to a third party, you have obtained their prior permission to submit it for assessment and service.
If you do not agree with any part of these Terms, we respectfully ask that you refrain from engaging our services.
3. Service Description
Sang Kala provides specialist horological services from our atelier in Kuala Lumpur. Our current service portfolio includes:
- Service-Level Movement Overhaul — a structured maintenance pathway for mechanical, automatic, and chronograph calibres, priced from MYR 980;
- Bracelet & Clasp Restoration — focused attention on steel, gold, and bi-metal bracelets affected by years of wear, priced from MYR 720;
- Heritage Chronograph Service — a specialised pathway for vintage and modern chronographs with complex complication depth, priced from MYR 1,790.
All services are performed at our KLCC atelier. We do not operate a postal or courier service channel. Geographic availability is limited to clients who can arrange in-person deposit and collection, whether directly or through a trusted representative.
Indicative pricing and timelines are communicated at intake. Final pricing may be revised where the scope of work differs materially from the initial assessment, and any such revision will be communicated to the Client before additional work proceeds.
4. Intake & Assessment
Upon receipt of a timepiece, the Atelier will conduct a written intake assessment and photographic documentation. This record serves as the reference condition of the piece at the point of submission. The Client should notify us in writing of any pre-existing damage, modifications, or known service history prior to or at the time of submission.
Should assessment reveal that the scope of required work differs materially from that initially described, the Atelier will contact the Client with a revised estimate. Work beyond the original scope will not proceed without the Client's written or recorded verbal authorisation.
5. Client Responsibilities
Clients are expected to:
- Provide accurate information regarding the timepiece, including brand, reference, known history, and any prior repairs;
- Disclose any known modifications, non-original parts, or prior damage that may affect assessment;
- Respond to communication from the Atelier within a reasonable period — typically within 7 business days — regarding revised estimates or service decisions;
- Collect the timepiece within 30 days of notification that service is complete. Extended storage arrangements can be made in writing;
- Treat Atelier staff and premises with courtesy and respect during all interactions.
The Client agrees not to make false or misleading representations regarding the timepiece, its provenance, or their authority to submit it for service. Any misrepresentation may render this Agreement void and may result in the return of the timepiece at the Client's cost.
6. Intellectual Property
All content produced by Sang Kala — including but not limited to written service documentation, photographic records, technical diagrams, website text, and marketing materials — remains the intellectual property of the Atelier.
The Client is granted a limited, non-exclusive, non-transferable right to access website content for the purposes of obtaining information about our services. This right does not extend to reproduction, distribution, adaptation, or commercial use of any Atelier-produced material without prior written consent.
Photographs or documentation produced during the service of a Client's timepiece are retained by the Atelier for internal quality records. The Atelier may use anonymised or cropped images for portfolio or educational purposes, provided no identifying information about the Client or their specific piece is disclosed without consent.
7. Payment Terms
All prices are quoted and invoiced in Malaysian Ringgit (MYR). Indicative service prices are as follows:
| Service | From (MYR) |
|---|---|
| Service-Level Movement Overhaul | 980 |
| Bracelet & Clasp Restoration | 720 |
| Heritage Chronograph Service | 1,790 |
- Payment is due upon collection of the timepiece unless otherwise agreed in writing;
- Accepted payment methods include bank transfer, cash, and major credit or debit cards as available at the time of collection;
- Where a revised estimate has been approved by the Client, the final invoice will reflect the agreed revised scope;
- The Atelier reserves the right to retain a timepiece until the full invoice amount has been settled;
- Refund requests arising from dissatisfaction with completed service work will be assessed individually. The Atelier does not issue refunds where work has been performed in accordance with the agreed scope and appropriate horological standards.
8. Service-Specific Terms
8.1 Scope and Changes
Work will be performed within the scope outlined in the intake assessment. Should unforeseen conditions be discovered during service — such as undisclosed damage, non-standard parts, or complications requiring specialist attention — the Atelier will pause work and contact the Client before proceeding.
8.2 Timelines
Indicative timelines are provided at intake and are subject to parts availability, complication depth, and workshop scheduling. The Atelier will communicate timeline updates as they arise. Timelines are indicative, not contractual commitments.
8.3 Parts
Where original manufacturer parts are unavailable, the Atelier will discuss alternatives with the Client prior to use. No non-original parts will be fitted without the Client's knowledge and agreement.
8.4 Uncollected Timepieces
Timepieces not collected within 90 days of completion notification, and where no alternative arrangement has been communicated, may be subject to storage fees or, in exceptional circumstances, transferred to the Atelier's unclaimed property process in accordance with applicable Malaysian law.
9. Disclaimers
While the Atelier applies considerable care and horological expertise to every timepiece, we cannot warrant specific outcomes in all cases. Certain conditions — including advanced corrosion, pre-existing mechanical fatigue, unavailability of parts, or pre-existing damage not disclosed at intake — may limit what can be achieved through service.
All information provided through our website and communications is offered in good faith for general informational purposes and does not constitute a formal quotation until confirmed in writing following physical assessment.
The Atelier does not claim affiliation with any watch manufacturer unless stated in writing. References to manufacturers' names are used for descriptive purposes only to identify calibre types and service requirements.
10. Limitation of Liability
The Atelier's liability for any claim arising from services performed shall not exceed the total value of the invoice for the specific service in question.
The Atelier shall not be liable for any indirect, consequential, or incidental losses, including but not limited to loss of use, sentimental value assessments, or costs arising from delays in service completion due to circumstances beyond the Atelier's reasonable control.
Nothing in these Terms limits liability for death or personal injury caused by the Atelier's negligence, or for any other liability which cannot be excluded under Malaysian law.
11. Indemnification
The Client agrees to indemnify and hold harmless Sang Kala, its principals, technicians, and representatives against any claims, damages, or expenses — including reasonable legal costs — arising from the Client's misrepresentation of ownership or authority over a submitted timepiece, or from the Client's breach of these Terms and Conditions.
12. Termination
Either party may withdraw from an agreed service at any point prior to work commencing, without penalty. Where work has commenced and the Client wishes to withdraw, costs incurred for labour and parts to that point may be invoiced.
The Atelier reserves the right to decline or cease service at its discretion in circumstances where the Client has provided materially false information, behaved inappropriately toward staff, or where proceeding with service would conflict with the Atelier's professional standards.
Provisions relating to payment, liability, indemnification, and dispute resolution shall survive the termination of this Agreement.
13. Dispute Resolution
These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
Prior to initiating formal proceedings, the parties agree to attempt resolution through good-faith communication. Clients with concerns are encouraged to contact the Atelier directly at [email protected] to allow an opportunity for informal resolution.
Where informal resolution is not achieved within 30 days of written notice, either party may pursue formal proceedings in accordance with Malaysian law, including mediation through the Malaysian Mediation Centre where appropriate.
14. General Provisions
- Entire Agreement: These Terms, together with any written intake or service documentation, constitute the full agreement between the Atelier and the Client regarding the services described.
- Severability: Should any provision of these Terms be found unenforceable, the remaining provisions shall continue in full effect.
- Waiver: Failure by either party to enforce any provision shall not constitute a waiver of future enforcement rights.
- Assignment: The Client may not assign their rights or obligations under this Agreement without prior written consent from the Atelier. The Atelier may engage sub-contractors or specialist third parties as required by the work, while retaining responsibility for outcomes.
- Notices: Formal notices under this Agreement should be directed in writing to the Atelier's registered address or to [email protected].
15. Changes to Terms
The Atelier may revise these Terms periodically to reflect changes in services, law, or operational practices. Where material changes are made, the updated version will be published on our website and noted with a revised "Last Updated" date.
Continued engagement with the Atelier following notification of revised Terms constitutes acceptance of those revisions. Clients uncertain about the effect of any revision are encouraged to contact us before proceeding.
